(The blood money is obligatory [(4)] for the killing of an insane person or a boy who brandished a sword at a man and he killed him): that is, what is known about him, (intentionally with his money): that is, the blood money is obligatory with his money; Because the rational person cannot bear (1) intentionality[(2)], (and the value): that is, the value is required, (in killing a camel that is righteous [(3)] upon him), this is according to us; Because he killed an innocent person and destroyed innocent property. Because the actions of a child, an insane person, or an animal do not negate the infallibility. Rather, retaliation is not required due to the presence of what is permissible, which is the repulsion of evil. On the authority of Abu Yusuf - may God be pleased with him -: It is necessary to be liable for the animal, not for the child and the insane person. Because their infallibility is due to their right (4), so it is voided by their action, and the animal’s infallibility is due to its owner, so it is not voided by their action (5). According to Al-Shafi’i - may God be pleased with him -: It is not obligatory to guarantee anything at all; Because he was killed to prevent (6) evil, as in the case of a rational adult.

If each one was intentional, then if there is an acquittal(1) between them, he shall be punished by amputation(2) and then by killing, and if he is not acquitted, then so is the case according to Abu Hanifa - may God be pleased with him -; Because cutting and then killing is the proverb in form and meaning, and with them: he is killed and not cut, so (3) the penalty of cutting is included in the penalty of killing, and this is fulfilled in the principles of jurisprudence (4)[(5)] in performance and judgment. And if both of them were wrong [(1)], then if there is a dissolution between them, then both of them are taken (2): That is, the blood money for amputation and killing is obligatory, and if there is no settlement between them, the blood money for the killing is sufficient; Because the blood money for cutting [(3)] is only obligatory when the effect of the act is established, which is to know (4) the lack of transmission, and the difference [(5)] between this situation and two intentional acts between which there is no exoneration, is that the blood money is an unreasonable example, so the basic principle is that it is not obligatory, unlike retaliation; It is a reasonable example. If he cuts intentionally and then kills by mistake, whether the two are acquitted or not, he shall be taken [by killing and amputation](6): that is, he shall retaliate for the cutting and the blood money for the soul shall be taken. If a cut is made by mistake and then he is killed intentionally, whether the two are acquitted or not, blood money is taken for the cutting, and retaliation is taken for the killing, due to the two crimes being different. Because one of them was intentional, and the other was a mistake.

(If he marries her by hand, or what happens from it, or due to a felony, and then dies, then the dowry of the same amount is due intentionally, and in the case of mistake, the dowry of the same amount is waived from the woman, and the rest is a will for them. If he leaves (1) a third, it falls, otherwise a third of the money is forfeited (2)), but the dowry of the same amount is obligatory in the case of intentionality; Because this man married on the basis of retaliation, and he is not suitable for a dowry, then the equivalent dowry must be paid [(3)], and she does not owe anything because of the killing; Because what is required is retaliation, and he dropped it.

If it was a mistake, the dowry of the same amount will be waived from the woman [(1)]; Because this man got married on the basis of blood money, and it is valid as a dowry[(2)], so if the equivalent dowry is equal to the blood money, and he has no money other than this, then there is nothing obligatory for the `Aqilah; Because marriage is one of the original needs, it is considered part of all wealth, and if the ideal dowry is more, it is not necessary to increase it. Because she was satisfied with less than the equivalent dowry, and if the equivalent dowry was less, then the increase is a bequest for the sane person, and it is valid because they are not murderers, and it is considered part of the third, so if (3) is excluded from (4) the third is dropped, otherwise the amount of a third of the money is dropped, and this is the difference between marriage by hand and marriage based on a felony, according to the words of Abu Hanifa - may God be pleased with him -, and as for them, the ruling on marriage by hand is as we mentioned in this issue, which is marriage based on a felony.
