I say: Each of the two explanations includes the two forms (1) [(2)], so the difference is not complete, but another matter must be included, which is that [the agent] (3) if the price is not paid claims (4) the price on the one who ordered it, and he denies it (5), then the statement is for the denier, and if the price is paid by the one who commanded it is claimed [and he denies it] (6), then the statement is for the one who denies it. (And he has the right to return the price to the one who ordered it to pay it to his seller or not): That is, the agent [(7)] in purchasing has the right to return the price to the one who ordered it if he does what he ordered (8) to do, whether the agent pays the price to his seller, or does not pay it. They made this issue based on the fact that [(9)] a legal exchange takes place between the agent and the principal, so the agent becomes a seller from his client, and he has the right to demand the price, even if he does not pay it to his seller.

(And he has the right to withhold the sold item [(1)] from his commander to collect (2) its price, even if he does not pay): Based on what we mentioned regarding the legal exchange, (if it perished in his possession[(3)] before withholding it from him, it perished on the ordering person and its price was not dropped, and after it was withheld [from him](1) it fell), then if (2) he withheld it from the ordering person to collect the price, and it perished in the hands of the agent, it would be guaranteed for the agent. Then there was a difference of opinion [about it](3): According to Abu Yusuf - May God be pleased with him - he guarantees the guarantee of the mortgage, and according to Muhammad - may God be pleased with him - which is the saying of Abu Hanifa - may God be pleased with him - he guarantees the guarantee of the thing sold, so what was mentioned in ((the text)) about the price being dropped is a reference to this doctrine, and according to Zafar - may God be pleased with him - he guarantees the guarantee of the usurpation, since according to him he does not have the right to withhold. If the price is equal to the value, there is no difference, and if the price is ten and the value is fifteen, then when Zafar - may God be pleased with him - he guarantees fifteen, and with the rest he guarantees ten, and if it is the opposite, then when Zafar - may God be pleased with him - he guarantees ten, and he demands the five from the client, and the same applies to Abu Yusuf (4) - may God be pleased with him -; Because the mortgage is guaranteed (5) for less than its value and the debt, and according to Muhammad - may God be pleased with him - it is guaranteed by the price, which is fifteen.

([(4) ] exchange and peace are invalidated by the agent’s departure[(1)] without commanding him). The form of peace is that he appoints a man to buy for him a grain of land with a peace contract. What is meant is not an authorization to sell the grain with a peace contract; Because this is not permissible, since the agent sells (2) food on his behalf, provided that the price goes to someone else, and there is no equivalent in Sharia law. Rather, it is considered the agent’s separation; Because the contracting party is the agent (3). (If he said: He sold me (4) this to Zaid, then he sold it, then denied the matter): That is, the buyer denied that Zaid ordered him to buy, (Zaid took it); Because his saying [(5)]: He sold me to Zaid is an acknowledgment of his authorization; Because this sale is only for Zaid if Zaid orders it, so he cannot be believed in denying his command, (for if he believes it, he will not take it by force): That is, if Zaid believes the buyer that he did not order it, he will not take it by force; Because the buyer's acknowledgment was rejected by his response, but he only said forcefully; Because if the buyer hands it over to Zaid, it will be a sale by way of transaction, so delivery (6) as a sale is sufficient for transaction, even if there is no cash for the price.

(And if a sold item is returned to an agent (1) with a defect that a similar one occurs or does not [occur] (2) [a similar one] (3) with proof, or a word, or an acknowledgment of its return to the one who ordered it, unless an agent acknowledges a defect that [a similar one] occurs (4), and he is obligated (5) to do so): that is, the agent sells the sale, then responds to him with the defect; If [(6)] the defect is something similar to it does not occur; Such as an extra finger, or something similar to it does not occur within this period (1) shall be returned to the commander, whether the response to the agent is with evidence, denial, or acknowledgment, even if the defect is something similar to it that occurs; If the response is by evidence or denial, then he must return it to the commander, and if it is by admission, he will not return it to the commander. The interpretation of the requirement of proof (2) or denial or acknowledgment in a defect that does not occur like it is that the judge may know that this defect does not occur like it within a month, but he is suspicious (3) about the date of sale and needs one of these arguments, or if the defect is known only to women or doctors, and the statement of the woman and the doctor is evidence in the direction of the dispute, not in the response; He lacks these arguments to respond, even if the judge inspects the sale and the defect is apparent (4) he does not need any of them.
