So we say (1) to Zafar[(2)](3) - may God be pleased with him - that his acknowledgment of what necessitates damage to himself or his organs, even if the Lord is harmed by it, is not accused of it; Because its harm exceeds the harm of the master, and if you feel in your heart that the wickedness of the souls of some Mamluks reaches such an extent that they prefer to destroy their souls in order to harm their masters, then that is a rare thing that is not suitable for rulings to be based on.

Then [(1)] after that, the basic principle according to Muhammad - may God be pleased with him - is that the return of the property and cutting it is a consequence of it due to the condition of the case [(2)], and the proof (3) [(4)] of the money without cutting it without reversing, and the acknowledgment of the interdicted slave with the money is not valid[(5)] so its consequence, which is cutting, is not proven. (If he turns it red [(1)] (2) and it is cut [(3)] then there is no return and there is no guarantee, and if he blackens it (4) then it is returned): That is, if he steals a garment and dyes it red and it is cut, the garment is not obligated to be returned, and if it is destroyed then there is no guarantee. According to Muhammad - may God be pleased with him - the garment is taken[(5)] and the excess dye is given(6). If its blackness was rejected by Abu Hanifa - may God be pleased with him -; Because blackness is a deficiency, it does not interrupt [(7)] the owner’s right, and the same applies to Muhammad - may God be pleased with him - as in the case of redness. Dyeing does not interrupt the owner’s right.

According to Abu Yusuf - may God be pleased with him - it is not rejected, because blackness is an increase like red[(1)], [so it cuts off the owner’s right](2).

If he was only wounded, or killed intentionally[(1)] then he repents: that is, he repents before he is taken, (or he is one of them who is not accountable(2), or has a mahram relative of the passers-by(3), or some passers-by cut off others(4), or he blocks the road day or night in Egypt(5) or between two Egypts, then there is no punishment[(6)], and the guardian[(1)] has the right to lead him, or bribe him, or (2) pardon him(3): That is, in the cases mentioned, the punishment is not required. Rather, if the killing was intentional, then the guardian is entitled to retaliation, and if it was not intentional, then the blood money is due, and the guardian is entitled to pardon. According to Abu Yusuf - may God be pleased with him - if some of them were not accountable, i.e. a boy or an insane person, then the wise people [(4)] proceeded to limit the rest.
